These Terms and Conditions ("Terms," "Terms and Conditions," "Agreement") constitute a legally binding agreement between you ("Customer," "you," or "your") and WP Hosting Pro ("Company," "we," "us," or "our"), located at 547 Garnett Knolls Apt. 804, Dickitown, MD 63298-5342, United States (Registration Number: 38337049).

By accessing our website at https://checkinghosting-live.com, purchasing our WordPress hosting services, or using any of our products, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following the posting of revised Terms constitutes your acceptance of such changes.

2. Service Description

WP Hosting Pro provides WordPress-optimized web hosting services, including but not limited to:

  • Shared WordPress hosting across multiple plans (Starter, Business, Professional, Enterprise, Ultimate)
  • Server space and bandwidth allocation
  • Domain management services
  • Email hosting services
  • SSL certificate provisioning
  • Backup and restoration services
  • Technical support and customer service
  • CDN (Content Delivery Network) integration
  • Security monitoring and malware scanning

Specific features and limitations vary by plan. Detailed specifications are available on our website and in your service agreement.

3. Account Registration and Eligibility

3.1 Eligibility

You must be at least 18 years of age to use our services. By agreeing to these Terms, you represent and warrant that you are of legal age to form a binding contract.

3.2 Account Information

When creating an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide truthful and accurate registration information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities conducted through your account

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

3.3 Account Security

You are solely responsible for maintaining adequate security and control of your account login credentials, passwords, and any other codes used to access our services. We are not liable for any loss or damage arising from your failure to maintain account security.

4. Payment Terms

4.1 Pricing and Fees

Current pricing for our hosting plans is displayed on our website. All fees are quoted in United States Dollars (USD) unless otherwise specified. Prices are subject to change with 30 days' notice for existing customers.

Applicable taxes (sales tax, VAT, GST, etc.) will be added to your invoice based on your location. You are responsible for paying all applicable taxes.

4.2 Billing Cycles

Our services are billed on a monthly basis unless you select an alternative billing period (quarterly, annually). Payment is due at the beginning of each billing cycle. Services are provided only upon receipt of payment.

4.3 Automatic Renewal

Unless you notify us before the end of your current billing period, your subscription will automatically renew for an additional equivalent period at the then-current rate. We will charge your payment method on file for the renewal.

To cancel automatic renewal, you must provide notice at least 7 days before your renewal date through your account dashboard or by contacting customer support.

4.4 Payment Methods

We accept payment via major credit cards (Visa, MasterCard, American Express, Discover), PayPal, and other payment methods as displayed during checkout. By providing payment information, you authorize us to charge all fees incurred.

4.5 Failed Payments

If payment fails for any reason, we will attempt to process payment up to three times over a 10-day period. If payment remains unsuccessful:

  • Your account may be suspended after 10 days
  • Your account may be terminated after 30 days
  • We may charge a late payment fee of $15 or 5% of the outstanding balance, whichever is greater
  • We reserve the right to delete your data after account termination

4.6 Price Changes

We reserve the right to modify pricing at any time. Price changes for existing customers will take effect at the next renewal period following 30 days' notice via email.

5. Acceptable Use Policy

5.1 Prohibited Activities

You agree not to use our services for any unlawful purpose or in any way that violates these Terms. Prohibited activities include, but are not limited to:

  • Hosting illegal content or engaging in illegal activities
  • Distributing malware, viruses, or malicious code
  • Conducting phishing, scamming, or fraudulent activities
  • Sending unsolicited bulk email (spam) or facilitating spamming
  • Hosting adult content (pornography, explicit material)
  • Infringing intellectual property rights (copyright, trademark, patent)
  • Engaging in harassment, hate speech, or discriminatory content
  • Mining cryptocurrency using our server resources
  • Running proxy servers or VPN services without authorization
  • Attempting to breach security measures or access unauthorized systems
  • Conducting network scanning, penetration testing, or security research without permission
  • Consuming excessive server resources that impact other users
  • Reselling hosting services without an authorized reseller agreement

5.2 Resource Usage

Each hosting plan includes specific resource allocations (storage, bandwidth, CPU, RAM). You agree not to exceed these limits. "Unlimited" features are subject to fair use policies and may not be used for file storage, backup, or distribution services unrelated to active websites.

We reserve the right to throttle, suspend, or terminate accounts that consume excessive resources or negatively impact server performance for other customers.

5.3 Enforcement

We reserve the right to investigate suspected violations of this Acceptable Use Policy. If we determine that you have violated these terms, we may:

  • Issue a warning and require corrective action
  • Suspend your account immediately
  • Terminate your account and delete your data
  • Report illegal activities to law enforcement
  • Pursue legal action for damages

We are not obligated to provide refunds for accounts terminated due to policy violations.

6. Content and Data

6.1 Your Content

You retain all ownership rights to content you upload, store, or display through our services ("Your Content"). By using our services, you grant us a limited license to host, store, backup, and display Your Content as necessary to provide our services.

6.2 Content Responsibility

You are solely responsible for Your Content and the consequences of posting, uploading, or publishing it. You represent and warrant that:

  • You own or have the necessary rights to Your Content
  • Your Content does not violate any laws or third-party rights
  • Your Content complies with these Terms and our Acceptable Use Policy

6.3 Prohibited Content

You may not upload, store, or distribute content that:

  • Is illegal, harmful, or fraudulent
  • Infringes intellectual property rights
  • Contains viruses, malware, or malicious code
  • Violates privacy rights or contains unauthorized personal information
  • Is defamatory, abusive, or harassing
  • Promotes violence, terrorism, or illegal activities

6.4 Content Backup

While we perform regular backups of server data, you are responsible for maintaining independent backups of Your Content. We are not liable for any loss, corruption, or deletion of Your Content, regardless of cause.

6.5 Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without notice or liability.

7. Service Availability and Uptime

7.1 Uptime Guarantee

We guarantee 99.9% uptime for Professional, Enterprise, and Ultimate plans, and 99.99% for Professional and higher plans where specified. Uptime is calculated monthly and excludes:

  • Scheduled maintenance (announced at least 48 hours in advance)
  • Outages caused by factors beyond our control (natural disasters, ISP failures, DDoS attacks)
  • Outages resulting from your actions or violations of these Terms
  • DNS propagation delays

7.2 Service Level Agreement (SLA) Credits

If we fail to meet our uptime guarantee, you may be eligible for service credits:

  • 99.0% - 99.8% uptime: 5% credit
  • 98.0% - 98.9% uptime: 10% credit
  • Below 98.0% uptime: 25% credit

Credits must be requested within 30 days of the incident. Credits are applied to future invoices and are not redeemable for cash.

7.3 Maintenance and Updates

We perform scheduled maintenance to ensure optimal performance and security. We will provide at least 48 hours' notice for planned maintenance. Emergency maintenance may be performed without notice when necessary to protect service integrity or security.

8. Technical Support

8.1 Support Services

We provide technical support through multiple channels:

  • Email support (all plans)
  • Live chat support (Business plan and higher)
  • Phone support (Professional plan and higher)
  • Priority support (Enterprise and Ultimate plans)

Support hours are 24/7 for all plans. Response times vary by plan level and issue severity.

8.2 Scope of Support

Our support covers hosting-related issues, including server problems, account access, and service features. Support does not include:

  • WordPress development or customization
  • Third-party plugin or theme troubleshooting
  • Website design or content creation
  • SEO optimization or marketing services
  • Custom scripting or programming

We offer premium support services for additional fees to cover advanced assistance needs.

8.3 Response Times

Target response times vary by plan:

  • Starter/Business: 24 hours
  • Professional: 4 hours
  • Enterprise: 1 hour
  • Ultimate: 30 minutes

These are targets, not guarantees. Actual response times may vary based on issue complexity and support volume.

9. Termination

9.1 Termination by Customer

You may terminate your account at any time by contacting customer support or through your account dashboard. Termination is effective at the end of your current billing period. No refunds are provided for unused portions of prepaid services, except as specified in our Refund Policy.

9.2 Termination by Company

We reserve the right to suspend or terminate your account immediately, without notice, if:

  • You violate these Terms or our Acceptable Use Policy
  • You fail to pay fees when due
  • Your activities pose a security risk to our systems or other users
  • We are required to do so by law or legal process
  • Providing services to you is no longer commercially viable

9.3 Effect of Termination

Upon termination:

  • Your access to services will be disabled
  • Your websites and email services will become unavailable
  • We will retain your data for 30 days to allow for data retrieval
  • After 30 days, all data will be permanently deleted
  • You remain responsible for all fees incurred before termination

10. Intellectual Property

10.1 Our Intellectual Property

The WP Hosting Pro website, services, and all related content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or create derivative works of our services
  • Reverse engineer or decompile any aspect of our services
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use our trademarks, logos, or branding without written permission

10.2 Trademarks

"WP Hosting Pro" and related logos are trademarks of our company. Other product and company names mentioned on our website may be trademarks of their respective owners.

10.3 DMCA Compliance

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe content hosted on our servers infringes your copyright, please submit a DMCA takedown notice to our designated agent at dmca@checkinghosting-live.com.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WP HOSTING PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • Our services will be uninterrupted, secure, or error-free
  • Results obtained from using our services will be accurate or reliable
  • The quality of services will meet your expectations
  • Any errors will be corrected

13. Indemnification

You agree to indemnify, defend, and hold harmless WP Hosting Pro, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your Content or activities on our services

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any dispute arising from these Terms or our services shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in Maryland, and judgment on the award may be entered in any court having jurisdiction.

14.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and WP Hosting Pro regarding our services.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or government actions.
